LANDLORD AND TENANT REPRESENTATION

  If you are a landlord who is having a problem with a tenant who won’t pay rent or is a nuisance, you should have an experienced and dedicated attorney help you start the eviction process and make sure the proper notices are sent to your tenant , and the proper legal advice is given. If you are a tenant facing eviction from your home or business, and not sure of your rights, don’t wait till the sheriff shows up with a notice saying you have to leave in 24 hours. You should call an experienced attorney once you receive your first notice.

LANDLORDS


If you’re a landlord dealing with some of these problems, in Florida there are specific and summary procedures laid out in Chapter 83, Florida Statutes. If you are seeking removal of a tenant, there are self help eviction services advertising they can help you with the eviction process. Since they’re not attorneys and can’t give legal advice, you might be open to be sued for wrongful eviction and other civil liability. Also, so called non-lawyer services may charge only a small fee, but that doesn’t include the costs of filing, service of process and other related amounts.

Since they can’t render legal advice, when you have a question, you’ll wind up being referred to one of their own referral attorneys and if an attorney is needed you’ll incur more costs. 

TENANTS


If you’re a tenant having an issue with your landlord or facing eviction in a residential lease, each lease is required to have attached all the laws regarding residential leases. Those laws spell out not only the landlord’s obligations but also what your landlord must comply with, if your trying to be evicted. One error by your landlord may prevent the eviction process from proceeding. Furthermore, the laws are very specific with respect to a landlord’s obligations relating to repairs and maintenance of the property.
